Personal Data and General Privacy Agreement
As NETSTABIL, in accordance with the Law on the Protection of Personal Data numbered 6698 (KVKK), within the framework of our obligation to inform under the KVKK and related legislation as the Data Controller, we would like to inform you about the purposes of processing your personal data, legal reasons, to whom it may be transferred, and your rights granted under the KVKK.
1. Personal Data and Protection of Personal Data
Personal data is any kind of information that identifies or is identifiable to an individual. Such information may include, for example, your name, address, email address, phone number, or data like the IP address of your computer when accessing the internet. Any process performed on personal data, whether fully or partially automatic or non-automatic, including but not limited to obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or preventing its use, is considered as processing of personal data.
In accordance with Law No. 6698 on the Protection of Personal Data and other relevant regulations, including those that are mandatory for us to process, your personal data shared with us in service agreements and other forms, especially regarding the privacy of private life, must be processed, protected, and, when necessary, transferred to third parties with great care. With the entry into force of Law No. 6698 on the Protection of Personal Data (except for the cases listed in Article 5/2 of the KVKK), processing is possible only if you explicitly consent. Since explicit consent is a strictly personal right, it can be withdrawn by the consenting party at any time.
2. Method of Collection and Legal Basis of Personal Data
Your personal data mentioned herein will be processed, stored, and, when necessary, transferred to third parties, provided that the processing conditions of personal data and the purposes specified in this Information Text, which are specified in Articles 5 and 6 of Law No. 6698, are observed;
a. In accordance with the law and honesty,
b. Accurately and, when necessary, up to date,
c. For specific, clear, and legitimate purposes,
d. In connection with the purpose of processing, limited, and measured,
e. For the period stipulated in the relevant legislation or required for the purpose of processing, it will be processed by automatic means or non-automatic means, provided that it is a part of any data recording system.
3. Personal Data Being Processed
Your personal data, which will be provided to authorized institutions and organizations when necessary, in accordance with the laws and within the framework of service contracts, includes but is not limited to: name, surname, date of birth, TR identity number, work and mobile phone numbers, email, work address, signature, data obtained when contacted through electronic or physical means, your call records kept in accordance with call center standards, your voice recording to be used as identity verification if requested, your request and transaction information in sales channels, your bank account information, IP address.
4. Purposes of Processing Personal Data
NETSTABIL will process your personal data for the following purposes:
a. To carry out the necessary work by our business units for the benefit of the relevant individuals from the products and services offered and to carry out the related business processes,
b. Planning and execution of human resources policies and processes,
c. Carrying out the necessary work by our relevant business units for the realization of the commercial activities conducted,
d. Planning and execution of activities necessary to personalize the products and services offered according to the preferences, usage habits, and needs of the relevant individuals and to recommend and promote them to the relevant individuals,
e. Planning and execution of commercial and/or business strategies,
f. Ensuring the legal, technical, and commercial-business security of individuals related to companies with whom any kind of business relationship is entered into,
g. Presentation, pricing, and invoicing of products and services; performing the requested transactions related to the products and services ordered, purchased, and/or used, and ensuring their follow-up,
h. Promotion and marketing of products and services; informing you about issues such as campaigns, discounts, pricing; providing opportunities such as membership, activities, and economic benefits, and performing the necessary procedures for their use,
i. Offering proposals, gifts, and promotions to you, targeted promotion; sending content that you may like, want to access again, or be pleased to remember; using the information you provide in this context for the event,
j. Verification of your identity information and documents when necessary; taking the necessary measures to prevent abuse, loss, and fraud,
k. Providing information to prosecutors, courts, and relevant public officials in cases related to public security and legal disputes, if necessary and within the framework of the purposes mentioned above; it may be shared with third parties for the purposes mentioned above when necessary,
l. Storage of your information that must be kept in accordance with the relevant legislation; copying and backing up to prevent information loss; ensuring the consistency of your information; taking the necessary technical and administrative measures for the security of your information,
m. Fulfillment of legal obligations, and the performance of legal follow-up and legal processes, as required by regulatory and supervisory authorities.
It may be processed, protected, and, when necessary, transferred to third parties for its purposes.
5. Your Rights Regarding the Processing of Personal Data
Article 20 of the Constitution states that everyone has the right to be informed about their personal data. In this regard, "request for information" is among the rights of the data subject in Article 11 of the KVKK. In this context, if the data subject requests information in accordance with Article 20 of the Constitution and Article 11 of the KVKK, the necessary information is provided. You can submit your requests regarding your rights under the KVKK to NETSTABIL in person or in accordance with the legislation (through a notary) to our postal address.
